Terms of Service

By creating an account or using Valytica (the “Service”), operated by Gnanalytica Technologies LLP (“Gnanalytica”, “we”, “us”), a limited liability partnership registered in India (LLPIN: ACQ-4389; registered office: SY NO 82 B1-205 SRADDHA, WHITECLIFF APT SEEGAHALLI, Bengaluru Rural, SEEGAHALLI POLICE STATION, Bengaluru Rural, Bengaluru Rural- 560115, Karnataka, India), you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a firm, you confirm you are authorised to bind that firm.

Valytica helps valuers create cases, extract fields from documents with AI assistance, run record checks, record site visits, compute valuations, and generate reports. AI-extracted values and insights are suggestions to assist a qualified valuer — you remain responsible for reviewing, verifying, and signing off on every valuation and report. Valytica is a tool, not a substitute for professional judgement.

You are responsible for the accuracy of your registration details and for activity under your account. Keep your sign-in credentials and one-time codes confidential. Notify us of any unauthorised use.

• Use the Service only for lawful valuation work you are authorised to perform.
• Upload only documents and data you have the right to process.
• Do not attempt to breach security, access other organisations’ data, or disrupt the Service.
• Do not misuse automated record/portal checks in violation of any portal’s terms or applicable law.
• The Valytica Capture browser extension reads a government portal only in your own signed-in session and only on a case you start it on; you remain responsible for using that portal within its terms, and for what you choose to save from it into a case.

Each firm receives 5 free cases. After those, each case costs ₹200, inclusive of applicable taxes, charged once from your wallet when the case is opened; its report is included. A free case is counted when the case’s first document is read.

Your wallet is a prepaid balance that can be used only to pay for Valytica cases. It cannot be transferred to another person or firm, cannot be withdrawn as cash, earns no interest and does not expire. Recharges are processed by Razorpay, and we issue an invoice (or a receipt) for each one. The Service is delivered online as soon as a recharge is credited; nothing is shipped.

Refunds and cancellations. Recharges are not refundable while your account is open, and the charge for a case is not refunded once the case has been opened, except where we charged you in error or the law requires a refund. When you close your account or your firm, or leave your workspace to join another firm, you may ask for any unused balance to be refunded to the original payment method: write to support@gnanalytica.com within 90 days and we will process the refund within 14 days of confirming it. A payment that is refunded or reversed through Razorpay, including a chargeback, is deducted from the wallet it credited.

You retain all rights to the documents, data, and reports you create. You grant us a limited licence to host and process them solely to provide the Service (including AI extraction as described in the Privacy Policy).

Documents you upload are your clients’ confidential information. To provide the Service they are processed by the sub-processors named in section 6 of the Privacy Policy— including an AI model that reads them, and, for market comparables, services that fetch public property listings using only a locality or area name, the city or district and the property type. You confirm that you have your client’s authority to have their documents processed in this way, and that doing so is consistent with your engagement terms and any professional code of conduct that binds you. If you are a registered valuer, that includes your duty of confidentiality.

For the personal data in your cases — the documents and the details of owners, applicants, borrowers and anyone else they mention — your firm is the data fiduciary and we act as its data processor under the Digital Personal Data Protection Act, 2023. We will:

• process that data only to provide the Service, on your instructions as given through the Service;
• keep it confidential, and give access only to our staff and the sub-processors named in the Privacy Policy who need it to run the Service, under obligations of confidentiality and security no less protective than these;
• maintain reasonable security safeguards, and tell you without delay, and in any case within 24 hours of becoming aware, of a breach affecting your data, with what we know about it;
• help you answer requests from the people whose data it is, and pass on to you any such request we receive;
• tell you of a change to our sub-processors through the Privacy Policy before it takes effect; and
• when your account or firm is closed, delete case data as described in section 7 of the Privacy Policy, except records the law requires to be kept, and let you export it first if you ask.

You are responsible for having a lawful basis to collect the personal data you upload and to have it processed in this way, and for giving the people concerned any notice the law requires (see section 6).

The Service is provided “as is”. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI outputs, record checks, or extracted fields are accurate or complete — verify them.

To the extent permitted by law, Valytica and Gnanalytica will not be liable for indirect, incidental, or consequential damages, or for losses arising from valuations or reports you produce using the Service. Our aggregate liability is limited to the fees you paid for the Service in the 3 months preceding the claim.

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or misuse. On termination, you may request export or deletion of your data as described in the Privacy Policy.

These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Hyderabad, Telangana.
